Public Notice is hereby given that the City Council of the City of Enterprise, Alabama at a regular meeting held on July 20, 2021, duly passed and adopted Ordinance 07-06-21-B. The ordinance in its entirety is as set out below.

ORDINANCE 07-06-21-B
AN ORDINANCE CONCERNING PROHIBITION OF PARKING
ON CERTAIN STREETS BEFORE, DURING AND AFTER CERTAIN DOWNTOWN EVENTS
BE IT ORDAINED AS FOLLOWS:
WHEREAS, the City Council finds for safety reasons and to lessen traffic congestion along Main Street for certain hours before, during and after the events occurring downtown when the City Council has approved road closures for said purpose, this Ordinance is necessary and is in furtherance of the health, safety and welfare of citizens and attendees;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENTERPRISE, ALABAMA, as follows:
Section 1. At least one hour prior to the commencement of an event in downtown Enterprise where the City Council has approved a road closure as to said event (said road closure to be approved by the City Council at a public meeting in advance), no vehicles (including cars, trucks, motorcycles, bicycles or any other type of vehicle designed to hold at least one or more drivers or one or more riders and including, but not necessarily limited to, vehicles powered by any source) shall be allowed to park or remained parked within the parking spaces within and adjoining Main Street, College Street and Railroad Street when the designation as stated above has been made that those streets or portions thereof have been closed. This parking prohibition shall remain in effect until at least one hour after the conclusion of said event. Nothing herein is intended to prohibit motorized carts designed to carry only one rider/driver as to some person who is legitimately disabled, baby strollers, or any emergency vehicles such as rescue squads, fire department vehicles or police vehicles.
Section 2. Violations of this Ordinance. Any violation of any provision of Ordinance shall be a misdemeanor punishable by a fine of not less than $100.00 or more than $500.00 per violation. In addition, the Chief of Police or his officers shall be authorized to cause the towing and removal of any vehicles wrongfully parked in violation of this ordinance, or otherwise place a device to cause any wrongfully parked vehicle to be immovable, with the costs of said towing or other such measures to be borne by the offender.
Section 3. This Ordinance shall become effective upon passage and immediately upon its publication.
Section 4. If any provision of this Ordinance, or the application thereof to any person, thing, or circumstances, is held invalid by a court of competent jurisdiction, such invalidity shall not affect the provisions or application of this Ordinance that can be given effect without the invalid provisions or application, and to this end, the provisions of this ordinance are declared to be severable.
