Default having been made in the payment of the indebtedness described in and secured by that certain mortgage executed by WILLIAM HUBERT SHEHEE, to David Wayne Hobbs and David Hobbs, Jr.on August 17, 2018 in Official Record Book 810 Page 77 dated August 17, 2018 in the Office of the Judge of Probate, Coffee County, Alabama and assigned to David Wayne Hobbs and David Hobbs, Jr. on August 17, 2018; notice is hereby given that the undersigned as mortgagee will under power of sale contained in said mortgage, sell at public outcry for cash to the highest bidder, during legal hours of sale on January 13, 2022, at the front door entrance of the Courthouse of Coffee County, Enterprise, Alabama, the following described real property in Coffee County, Alabama, being the same property described in the above referenced mortgage:

Lot No 16 in Block C of the Bama Subdivision in the City of Enterprise, Coffee County, Alabama, as recorded in Plat Book 1, Page 47 and 48 in the Office of the Probate Judge, Enterprise, Coffee County, Alabama, and being bounded on the South by West Park Avenue, East by Helms, North by Emory Evans, West by E. G. Brunson, said lot being 80 x 200 feet.

This property will be sold on an As-Is, Where-is basis subject to any easements, encumbrances and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate where the above-descried property is situated.  This property will be sold without warranty or recourse, expressed or implied as to the title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

Said sale is made for the purpose of paying the said indebtedness, any recorded senior indebtedness, and the expenses incident to this sale, including a reasonable attorney's fee. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit of the status of the loan with the mortgagee.

The mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
