NOTICE OF ADOPTION

ORDINANCE 12-15-20-A

Public Notice is hereby given that the City Council of the City of Enterprise, Alabama, at a regular meeting held on December 15, 2020 duly passed and adopted Ordinance 12-15-20-A.  The ordinance in its entirety is as set out below.

ORDINANCE 12-15-20-A

TO AMEND THE ORGANIZATIONAL RULES OF THE COUNCIL

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENTERPRISE, ALABAMA as follows:

WHEREAS, in order to make regular or special meetings (as the case may be) of the Council more efficient and in recognition of the fact that certain administrative matters regularly re-occur on each Council agenda which are part of the ordinary course of business of the Council, the Council finds it in the best interest of efficient government operations to amend its organizational rules (Ordinance 11-02-20) to allow the implementation of a consent agenda to include the following items:  approval of regular or special meeting agenda, approval of meeting minutes, accounts payable, contract billings, travel requests, and disposal of property;

NOW, THEREFORE, THE COUNCIL DOES ORDAIN AND AMEND ORDINANCE 11-02-20 as follows:

1.      The Council does approve and direct the implementation of a consent agenda which will appear on the agenda of the Council after roll call and pledge of allegiance and be referenced as “Consideration of Consent Agenda.”  The consent agenda will include the following items:  regular meeting agenda, approval of meeting minutes, accounts payable, contract billings, travel requests, and disposal of property.  The consent agenda will be introduced, motioned for approval and voted upon by the Council just as other Council action is so considered, and the items thereon shall be deemed cumulatively approved upon majority vote without the necessity of separate oral presentations as to each item.  Such approval shall have the same force and effect as if the items were so presented. 

2.      The consent agenda, with supporting documents related thereto, will appear in each Council Members’ packet for the applicable meeting and the consent agenda with supporting documents shall at all times remain open to inspection by the public as may be required by law.  Further, the items on the consent agenda as set out above, and the action taken related thereto, shall appear in the minutes of any such regular or special meeting in such detail that it is clear to the reader what was considered as part of the consent agenda and the corresponding action taken in reference thereto. 

3.      At any time by majority vote of the Council, the Council during consideration of the consent agenda may move to amend the same or otherwise cause any item thereon to be taken off the consent agenda for consideration as part of the regular agenda in the applicable meeting or to remove the same or otherwise to lay the same over for future consideration, if any.  Further, the Council may by majority vote cause a new item to be added to the consent agenda for future meetings.

4.      Any provision of Ordinance 11-02-20 which is in conflict with this ordinance is hereby superseded by this ordinance. 

5.      This ordinance shall go into effect after passage or otherwise in accordance with the law.
