NOTICE OF ADOPTION AND FINAL PASSAGE OF ORDINANCE 06-01-21

GRANTING SPECTRUM SOUTHEAST, LLC a/k/a CHARTER COMMUNICATIONS

A CABLE TELEVISION FRANCHISE

            Pursuant to Alabama Code §11-45-8, the City Council of City of Enterprise gives notice of adoption and final passage of Ordinance No. 06-01-21 granting Spectrum Southeast, LLC a/k/a Charter Communications a non-exclusive cable television system franchise. 

            The purpose and effect of the ordinance relate to the approval of Spectrum Southeast, LLC a/k/a Charter Communication (“Spectrum”) maintaining a non-exclusive franchise to construct, operate and maintain a cable television system in the City of Enterprise for a ten (10) year period from the execution of the franchise agreement by Spectrum, which is expected to take place in July of 2021.  The Ordinance grants Spectrum the right to use City right of ways to construct, operate and maintain its cable system in accordance with the terms of the franchise agreement.  Spectrum will pay to the City five percent (5%) of gross revenues as defined in the franchise agreement.

            The categories of the businesses affected by the granting of the franchise are cable television systems and the substance of the ordinance is as stated above.

            The Ordinance was passed on July 6, 2021, and takes effect on the date of this publication, subject to Spectrum’s signature on the franchise agreement which is expected to occur prior to the expiration of July, 2021.

            A copy of the full ordinance is available for inspection at the Office of the City Clerk, City Hall 501 South Main Street, Enterprise, Alabama, between the hours of 7:30 am to 4:30 pm.
