NOTICE OF FORECLOSURE
Default having been made in the payment of the indebtedness secured by that certain purchase money mortgage dated March 23, 2011, executed by Dennis Johnson and Barbara Johnson, husband and wife, to Barbara A. Collette, which mortgage was recorded on March 24, 2011, in OFFREC BK 556, PG 231, of the public records in the Office of the Judge of Probate of Coffee County, Alabama, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the main entrance to the Coffee County Courthouse at Enterprise, Alabama, during the legal hours of sale on October 30, 2019, the following described real estate situated in Coffee County, Alabama, to-wit:
A parcel of land located in the NE ¼ of the SW ¼ of Section 15, T4N, R22E, in the Town of Enterprise, Coffee County, Alabama, and being more particularly described as follows by an engineering survey: Beginning at the southwest corner of the NE ¼ of the SW ¼ of Section 15, T4N, R22E, thence N87degs-35’E a distance of 283.28 feet along the south line of the said forty to the west line of a fifty foot street; thence N09degs-10’E a distance of 306.29 feet along the west line of said street; thence N46degs-045’W a distance of 23.43 feet, along the southwest line of a fifty foot street to the beginning point of a fifty foot radius Cul-de-sac; thence N80degs-15’W a chord distance of 44.63 feet along the curve (fifty foot radius) to a point on the Cul-de-sac; thence N85degs-59’W a distance of 288.14 feet to the west line of the NE ¼ of the SW ¼ of Section 15, T4N, R22E; thence S03degs-00’E a distance of 318.16 feet along the west line of said forty to the point of beginning. The herein described parcel contains 2.4 acres.
Also, a non-exclusive easement for ingress and egress described as follows: A fifty foot wide street from Ouida Street to Lot 4 of the Donaldson Subdivision being more particularly described as follows: Beginning at a point on the west line of Ouida Street, which point is N16degs-33’E a distance of 121.62 feet from the south line of the NE ¼ of the SW ¼ of Section 15, T4N, R22E; thence N69degs-30’W a distance of 495.30 feet (25 feet on each side of this line); thence S09degs-10’W a distance of 314.42 feet (25 feet on each side of this line).
This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances and exceptions reflected in the mortgage and those contained in the said public records of the office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied, as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
