MORTGAGE FORECLOSURE NOTICE

WHEREAS, Gregory Snow and Jane M. Snow, husband and wife, executed to Habitat for Humanity of Coffee County, Alabama, Inc.on September 15, 2005, mortgages upon real estate hereinafter described to secure an indebtedness described herein, namely a First Mortgage  being recorded in the Office of the Judge of Probate, Enterprise Division, Coffee County, Alabama in OR 327 Page 31 on 09/16/2005 and a Second Mortgage being recorded in the Office of the Judge of Probate , Enterprise Division, Coffee County, Alabama in OR 327 page 44 on 09/16/2005 .

WHEREAS, default has been made by the mortgagor in the payment of the indebtedness secured by said mortgages and/or in the performance of the terms of said mortgages, and said default continuing;

NOW THEREFORE, Habitat for Humanity of Coffee County, Alabama, Inc., will sell, under and by virtue of the power of sale contained in said mortgages between the legal hours of sale on May 9, 2019 at public auction, for cash to the highest bidder, at the front door of the Coffee County Courthouse, in the City of Enterprise, the real, estate embraced in said mortgages described as follows:

One lot or parcel of land in Coffee County, Alabama as surveyed by Kinsaul & Associates, as per plat dated March 19, 2003, Job No. 03082E, and being more particularly described as follows: COMMENCING at a point where the centerline of West Watts Street intersects an extension of the Northeasterly Right of Way (R/W) Line of North Rawls Street; thence along the Northeasterly Right of Way line of North Rawls Street and an extension thereof, N33° 38’ 00”W for a distance of 440.90 feet to a ½” iron pin found (cap #9987); thence continue along said back of sidewalk and R/W line N33° 03’ 15”W for a distance of 70.79 feet to an iron pin set (IPS) (1/2” rebar, cap #19258) and the POINT OF BEGINNING; thence continue along said back of sidewalk and R/W line N33° 03’ 36”W for a distance of 70.80 feet to an IPS; thence leaving said back of sidewalk and R/W line N52° 57’ 20”E for a distance of 165.80 feet to an IPS; thence S33° 37’ 59”E for a distance of 70.76 feet to an IPS; thence S52° 57’ 30”W for a distance of 166.51 feet to the POINT OF BEGINNING. Said land is located in the NE¼ of the SE¼ of Section 17, T4N, R22E and contains 0.269 acres, more or less.

Subject to all easements, restrictions, right-of-way, mineral and mining rights and other matters which exist as a matter of record or exist defacto.

NOTE: Said sale and any conveyances made in consummation thereof, will be subject to any existing Federal Tax Liens, if any, and/or special Assessments, if any, which might adversely affect the title to the subject property.

Said sale will be made for the purpose of realizing the mortgage debt, together with all expenses of this sale, including a reasonable attorney's fee.

Said property will be sold without warranty or recourse, express or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled hereto.
