Whereas, John Bruce Barley, a single man executed to First South Farm Credit, ACA, on June 30, 2015 a mortgage upon real estate hereinafter described to secure an indebtedness described therein, said mortgage being recorded in the Office of the Judge of Probate, Coffee County, Alabama on June 30, 2015 in OFFREC BK 706 PG 71;

Whereas, default has been made by the Mortgagor in the payment of the indebtedness secured by said mortgage and/or in the performance of the terms of said mortgage, and said default continuing;

NOW THEREFORE, First South Farm Credit, ACA, as Mortgagee and owner of said mortgage, will sell, under and by virtue of the power of sale contained in said mortgage between the legal hours of sale on Thursday February 27, 2020 at public auction, for cash to the highest bidder, in front of the main door of the Coffee County Courthouse, in the City of Enterprise, Alabama, the  following real estate embraced in said mortgage described as follows:

Parcel One: The E1/2 of the NE1/4 of SE1/4, Section 6, and all that part of the NW1/4 of SW 1/4, Section 5, lying West of Weeks Bridge-Goodman Dirt Road, all in Township 4 North, Range 21 East BUT LESS AND EXCEPT a strip or parcel of land 420 feet in width North and South across the entire North side of the above described land.  The land hereby conveyed consists of 38 acres, more or less.

Parcel Two: The SW1/4 of NE1/4 of Section 5, Township 4 North, Range 21 East, Coffee County, Alabama, containing 40 acres, more or less.

Parcel Three:  N1/2 of N1/2 of NE1/4 of SW1/4, Section 5, Township 4 North, Range 21 East, and all that portion of NW1/4 of SW1/4, Section 5, Township 4 North, Range 21 East, lying directly West of the above described property and East of Weeks Bridge-Goodman Dirt Road, Containing 10.5 acres, more or less, and being in Coffee County, Alabama

Said property will be sold on an "as is", "where is" basis subject to any easements, conditions and restrictions of record in the Probate Office of Coffee County, Alabama, and will be subject to any existing Federal Tax Liens, if any, and/or special Assessments, if any, which might adversely affect the title to the subject property. Neither the mortgagee, assignee or holder, or its/their officers, directors, employees, attorneys, agents or representatives make any representation or warranty relating to the title or any physical condition, environmental, health or safety condition existing in, on, at or relating to the property offered for sale.

Said property will be sold without warranty or recourse, express or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled hereto.  Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances.  Programs may also exist that help persons avoid or delay the foreclosure process. An attorney should be consulted to help you understand these rights and programs as part of the foreclosure process.

Said sale will be made for the purpose of realizing the mortgage debt, together with all expenses of foreclosure, including a reasonable attorney's fee.
