Daleville man back in jail on felony charges with no bond

A 23-year-old Daleville man is back in jail just over three months since he bonded out the last time.

James Tanner Jr. is being held in the Dale County Jail on six separate charges. Currently, he is under no bond. A bond revocation hearing (on previous charges) set for Tuesday afternoon, April 12, was continued until May 10 by 33rd Judicial Circuit Judge Kimberly Clark, said Dale County Sheriff Department’s Chief Deputy Mason Bynum.

Sheriff’s deputies arrested Turner in the 200 block of Atlas Street in Ozark Wednesday, April 6 on two outstanding warrants plus a third degree assault charge, stemming from an fighting incident earlier in the week.

After he was arrested, Turner would not give permission for authorities to search the house where he was staying, according to Bynum. A search warrant was obtained and executed and marijuana was found, along with methamphetamines and a handgun, Bynum said.

Additional charges were made for first-degree possession of marijuana, possession of a controlled substance and possession of a firearm (by a convicted felon). Bynum said both of the drug possession charges are Class C felonies.

According to Alabama law, possession of less than 28 grams of methamphetamine is aClass C felony, punishable with a possible one to 10 years in prison and up to a $15,000 fine; possession of more than 28 grams, but less than 500 grams is also a Class C felony with a possible sentence of three years in jail and up to a $50,000 fine; possession of less than 2.2 pounds of marijuana is considered a misdemeanor, punishable with up to a year in jail and up to a $6,000 fine; and possession of more than 2.2 pounds of marijuana is considered a Class C felony with a possible sentence of one to 10 years and up to a $15,000 fine.

Bynum said county authorities will likely seek a federal firearm possession charge as well. The Daleville Department of Public Safety is seeking a similar federal firearm charge stemming from the man’s actions in January when he pointed a gun while fleeing from Daleville police. Alabama law prohibits a convicted felon from possessing a firearm.

Tanner has a history of multiple foot chases and criminal history with felony and misdemeanor charges and has served time in state prison, according to arrest and court records.

In January, he was charged with attempting to elude police; criminal mischief, third degree; criminal trespassing, third degree; criminal trespassing, second degree; and criminal mischief, third degree. The previous charges stem from incidents in December 2015 and in January. According to Bynum, Tanner has not yet been indicted on the earlier charges and it is from those charges that a bond revocation is being sought.

In 2010 and 2012, Tanner had various charges against him, some of which he served time for.
