FIRST NOTICE OF PUBLIC HEARING ORDINANCE

First public notice is hereby published in The Southeast Sun, a newspaper of general circulation in the City of Enterprise, Coffee County, Alabama, that pursuant to Title 11-52-77, Code of Alabama, 1975, as amended, the City Council of the City of Enterprise at a regular meeting at 6:00 p.m., August 6, 2019 at City Hall, 501 South Main Street, will consider for adoption Ordinance 07-02-19 which proposes to amend the applicable Zoning Ordinance(s) as amended and the Zoning Map of the City of Enterprise, Alabama.

A public hearing will be held by said City Council of the City of Enterprise at the aforesaid time and place before passage and adoption of said ordinance, when at that time, all persons who desire shall have an opportunity of being heard in opposition to or in favor of said ordinance.

The proposed ordinance is as set out in its entirety in this notice.

ORDINANCE 07-02-19

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENTERPRISE, ALABAMA as follows:

Upon public notice and hearing as required by law, and following recommendation of the Planning Commission of the City of Enterprise, Alabama, previous Zoning Ordinance(s) and the Zoning Map of the City of Enterprise, Alabama, adopted herein and on file in the Office of the City Clerk and the Office of the City Engineering Department, City of Enterprise, is hereby amended and, as amended, shall reflect the following:

A lot or parcel belonging to Richard Fleming being located in the City of Enterprise, Coffee County, Alabama and being further described as follows: COMMENCE at the intersection of the West Right of Way of Bellwood Rd (R/W Varies) and the North Right of Way of Bowden Dr. (30' R/W) being a 1/2 " rebar with cap stamped (Kinsaul) said point also being the POINT OF BEGINNING.

From said POINT OF BEGINNING thence along the North Right of Way of Bowden Dr. S85˚37' 49"W a distance of 221.39 feet to a 1/2 " rebar with cap stamped #19258; thence leaving said Right of Way N0341'51"E a distance of 250.16 feet to a 1/2 " open top pipe; thence S85˚10' 37"W a distance of 124.86 feet to a crimp top pipe; thence N03˚41'32"E a distance of 386.79 feet to a R.R. spike; thence S89˚11'01" E a distance of 34.60 feet to a R.R. spike; thence N03˚23'29"E a distance of 213.53 feet to a 1/2 " rebar with cap (unreadable) on the South Right of Way of Sims St. (30' R/W); thence N89˚12'07"E a distance of 93.13 feet to a 1/2 " open top pipe; thence leaving said Right of Way S04˚01'08"W a distance of 417.30 feet to a 1/2 " open top pipe; thence N88˚07'32"E a distance of 166.07 feet to a "x" in concrete on the West Right of Way of Bellwood Road (R/W varies); thence along said West Right of Way S03˚45'35"E a distance of 412.26 feet to the POINT OF BEGINNING. Said parcel lying in and being a part of the Southeast Quarter of the Southwest Quarter of Section 21, Township 4 North, Range 22 East and containing 3.39 acres, more or less. Said property, set out in detail of the records of the Planning Commission.
