ORDINANCE 03-02-21

Public Notice is hereby given that the City Council of the City of Enterprise, Alabama at a regular meeting held on April 6, 2021 duly passed and adopted Ordinance 03-02-21.  The ordinance in its entirety is as set out below.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENTERPRISE, ALABAMA as follows:

Upon public notice and hearings as required by law, and following recommendation of the Planning Commission of the City of Enterprise, Alabama, previous Zoning Ordinance(s) and the Zoning Map of the City of Enterprise, Alabama, adopted herein and on file in the Office of the City Clerk and the Office of the City Engineering Department, City of Enterprise, is hereby amended and, as amended, shall reflect the following:

A lot or parcel belonging to Thomaston Company, LLC being located in the City of Enterprise, Coffee County, Alabama and being further described as follows:

A PARCEL OF LAND SITUATED IN THE SW ¼ OF SECTION 3, ALL IN TOWNSHIP 4 NORTH, RANGE 22 EAST, COFFEE COUNTY, ALABAMA AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

COMMENCING AT A 3/4” PIPE MARKING THE SE CORNER OF THE NE ¼ OF THE NW ¼ OF SAID SECTION 10; THENCE N00°27’31”E A DISTANCE OF 730.00 FEET TO A ½” REBAR #1082; THENCE N60°13’52”W A DISTANCE OF 297.96 FEET TO A ½” REBAR #1082; THENCE N75°32’47”W A DISTANCE OF 412.75 FEET TO A ½” REBAR #1082; THENCE N76°43’06”W A DISTANCE OF 381.98 FEET TO A ½” REBAR #1082; THENCE N53°07’25”W A DISTANCE OF 438.46 FEET TO A ½” REBAR #1082; THENCE N51°07’55”W A DISTANCE OF 476.38 FEET TO A ½” REBAR #1082 AND THE EAST RIGHT OF WAY OF OZARK HIGHWAY (ALABAMA HIGHWAY #27); THENCE ALONG SAID EAST RIGHT OF WAY N21°09’39”E A DISTANCE OF 1,009.09 FEET TO A NAIL IN THE CURB AND THE SOUTH RIGHT OF WAY OF PORTER LUNSFORD ROAD; THENCE ALONG SAID SOUTH RIGHT OF WAY N89°41’32”E A DISTANCE OF 236.40 FEET TO A POINT, SAID POINT BEING THE POINT OF BEGINNING; THENCE, FROM SAID POINT OF BEGINNING, CONTINUE ALONG SAID RIGHT OF WAY N89°41’32”E, A DISTANCE OF 214.91 FEET TO A POINT ON SAID RIGHT OF WAY; THENCE DEPARTING SAID SOUTH RIGHT OF WAY S21°09’39”W, A DISTANCE OF 752.91 FEET TO A POINT; THENCE N68°50’44”W, A DISTANCE OF 200.00 FEET TO A POINT; THENCE N21°09’39”E, A DISTANCE OF 674.27 FEET TO THE POINT OF BEGINNING.  SAID PARCEL CONTAINS 3.28 ACRES, MORE OR LESS.

Said property, set out in detail in the records of the Planning Commission and described by Map A (R-65, Residential District) is amended and, as amended shall be zoned and described by Map B (B-3, Highway Commercial District) which is attached hereto and is a permanent part of the Zoning Ordinance and Map.
